RE: Approval of a Discharge of Declaration of Restrictive Covenant on a vacant parcel
recommendation
BOARD ACTION REQUESTED:
Approval of a request to discharge a Declaration of Restrictive Covenant on a County owned vacant lot.
BACKGROUND:
A resident has expressed interest in purchasing an adjacent vacant lot on Yale St. in Mt. Morris. When the deed was pulled, there was a Declaration of Restrictive Covenant attached. This Declaration was the result of an anticipated supportive housing program that GCCARD entered in 2007. The program never materialized.
DISCUSSION:
Since the program never materialized and no HUD funding was used, the Board must take action authorizing the execution of the Discharge of Declaration of Restrictive Covenant. Once removed, we'll engage with the adjacent property owner for possible sale.
IMPACT ON HUMAN RESOURCES:
There is no impact on Human Resources.
IMPACT ON BUDGET:
By selling the property, the parcel will become taxable again resulting in a positive impact on Genesee County's budget.
IMPACT ON FACILITIES:
There is no impact on Facilities.
IMPACT ON TECHNOLOGY:
There is no impact on Technology.
CONFORMITY TO COUNTY PRIORITIES:
In removing this Covenant, we are working with our residents to encourage community and economic growth.
