TO THE HONORABLE CHAIRPERSON AND MEMBERS OF THE GENESEE COUNTY BOARD OF COMMISSIONERS, GENESEE COUNTY, MICHIGAN

LADIES AND GENTLEMEN:

WHEREAS, Resolution 23-536, approved by this Board of Commissioners on September 27, 2023, authorized the reorganization of the Genesee County Prosecutor’s Office; and

                     WHEREAS, the goal and intention of the Prosecutor’s Office with this resolution was to increase the retention and recruitment of qualified staff for all divisions and all positions, both union and non-union; and

                     WHEREAS, it has been brought to the attention of the Prosecutor’s Office that there is a desire by the Board of Commissioners to clarify the intentions and effect of the reorganization in a more specific resolution; and

                     WHEREAS, the funding source for the criminal division’s portion of the reorganization was a state budget apportionment and had no effect on the Genesee County general fund; and

                     WHEREAS, ample supporting documentation was provided with Resolution 23-536 outlining the additional positions requested, the new positions requested, the requested pay increases to existing positions, and the additional staffing requirements for all departments and divisions of the Genesee County Prosecutor’s Office; and

                     WHEREAS, upon the advice of the Genesee County Human Resources Department the intention of Resolution 23-536 was for existing union-staff to reapply for any newly titled and/or newly established and amended positions with updated pay scales; and

                     WHEREAS; the intention of Resolution 23-536 was to increase the total number of employees in the criminal divisions of the Prosecutor’s Office by up to thirty (30) new employees; and

                     WHEREAS; as demonstrated by the supporting documentation previously attached to Resolution 23-536, and reattached to this resolution, the intention of Resolution 23-536 was for non-union appointed staff within the criminal divisions and the elected official known as the Genesee County Prosecutor to be increased pursuant to the supporting documentation;

                     WHEREAS; it is clear that for the criminal division that Resolution 23-536 and its supporting documentation was intended to allow for the authorization of the creation of new positions and increases to current elected, appointed, and union positions to not exceed the $3,000,000 apportionment by the state of Michigan; and

                     WHEREAS, the reorganization plan and the Prosecutor’s Office also includes a civil division currently known as the office of Corporation Counsel that was also included in the supporting documentation for reorganization in Resolution 23-536 by creating a new position and pay scale; and

                     WHEREAS, the corporation counsel reorganization simply created the position of Deputy Corporation Counsel with a new pay scale; and

                     WHEREAS, the funding source for the Deputy Corporate Counsel position(s) has not yet been secured;

                     NOW THEREFORE BE IT RESOLVED by this Genesee County Board of Commissioners that the following positions within the Genesee County Prosecutor’s Office shall have the following pay scales:
