BOARD ACTION REQUESTED:
Accept for filing a memorandum of understanding between the Clerk-Register and the Chief Judge of the Circuit Court relative to an assignment of duties for the Legal Records Division to the Circuit Court.
BACKGROUND:
The Clerk-Register and the Chief Judge of the Circuit Court have determined that it is in the best interest of the public and employees of both organizations to assign operational authority for the Legal Record Division to the Circuit Court.
DISCUSSION:
This MOU is the culmination of a dialogue between the Clerk-Register and the Chief Judge that spans the tenure of multiple Chief Judges. It is because of the cooperation of the current Clerk-Register that this is able to move forward. All circuit court records must be maintained consistent with the standards established by the Michigan Supreme Court, e-filing is in the midst of a mandatory statewide roll-out and presents an opportune time for the court to assume responsibility for the daily operations of the legal records division. The emerging Legal Resource Center will have a close working relationship with the legal records division as the point of public access for court filings.
IMPACT ON HUMAN RESOURCES:
One (1) additional manager position will be created as part of the leadership team. This position will be addressed in resolution number 2023-858.
IMPACT ON BUDGET:
The existing budget for the legal records division will be transferred by budget amendment. This will be addressed in resolution number 2023-865.

CONFORMITY TO COUNTY PRIORITIES:
Accepting this memorandum of understanding will promote long term financial stability and safer communities by designing a responsive point of public access for court filings.

LADIES AND GENTLEMEN:
BE IT RESOLVED, by this Board of County Commissioners of Genesee County, Michigan, that the request by the Circuit Court Administrator to accept a Memorandum of Understanding between the Clerk Register and Chief Judge of the Circuit Court relative to an assignment of duties for the Legal Records Division of the Circuit Court is approved (a copy of the memorandum request and supporting documentation being on file with the official records of the November 29, 2023, meeting of the Governmental Operations Committee of this Board).
