BOARD ACTION REQUESTED:
Approval of an MOU with GHS to allow for the expenditure of Mental Health Millage funding

BACKGROUND:
Genesee County voters approved a Mental Health Millage that dedicated funding to Genesee Health System to provide mental health services to county residents.

DISCUSSION:
The current MOU expires in June.  This would provide an extension of the agreement through the end of the millage authorization.

TO THE HONORABLE CHAIRPERSON AND MEMBERS OF THE GENESEE COUNTY BOARD OF COMMISSIONERS, GENESEE COUNTY, MICHIGAN

LADIES AND GENTLEMEN:

WHEREAS, on May 4, 2021, the residents of Genesee County, Michigan, authorized Genesee County (the “County”) to levy and to collect a property tax to be used to provide dedicated funding through the Genesee Health System (“GHS”); and

WHEREAS, the statement of purpose included in the Millage ballot as required by MCL 211.24f(2)(d) stated in part that “100% shall be allocated to the Genesee Health System for mental health crisis, stabilization and prevention, and to meet mental health needs in an appropriate setting, thus reducing the burden on jails and improving care of all Genesee residents who seek help;” and

WHEREAS, the County is required by law to collect the funds generated by the Millage from the county taxpayers, and is further required by law to transfer the Millage funds to GHS to carry out the Millage requirement that 100% of the Millage funds be allocated to GHS, and in consideration of these compulsory legal responsibilities, the County anticipates it will have added administrative costs associated with such tasks that logically should be paid from the Millage revenues; and

WHEREAS, the County Board of Commissioners previously entered into a Memorandum of Agreement with GHS for the proper administration of the Millage funds in accordance with the law and the Enabling Resolution, to establish means and methods for GHS to provide the County with information regarding the operations of GHS and the GHS Board in connection with the Millage as authorized by the Enabling Resolution, and to account for the County’s costs of administering the Millage; and

WHEREAS, the previously entered Memorandum of Agreement term is set to expire at the end of June 2023.

NOW, THEREFORE, BE IT RESOLVED, by this Board of County Commissioners of Genesee County, Michigan, that the recommendation and request to authorize entering into the Memorandum of Agreement related to the use of taxpayer money collected following the County’s levy of the Genesee Health System’s Community Mental Health Millage for a period of four years through the end of the current millage authorization in 2030, is approved (a copy of the memorandum request being on file with the official records of the June 10, 2026 meeting of the Human Services Committee of this Board), and the Chairperson of this Board is authorized, after approval by Corporation Counsel, to execute the Memorandum of Agreement on behalf of Genesee County.
