BOARD ACTION REQUESTED:
Approval to enter into a Contract with the Road Commission to meet the Phase II Storm water regulations and authorize the Drain Commissioner as County Agent to sign contract on behalf of Genesee County.
BACKGROUND:
The Contract is a continuation of an existing contract. The Genesee County Board of Commissioners has designated the Drain Commissioner, 342 Agency in Genesee County for the Genesee County Storm Water Management System. The County is subject to the requirements of the Phase II Storm Water Regulations. Genesee County nests its County Agencies: Facilities and Operations properties, Parks and Rec Properties, Genesee County Drain Commissioner’s Office and including entering into contract to nest the Genesee County Road Commission to combine efforts and reduce costs to all parties. The County contribution to this program is $90,000 is general fund and the other $40,000 is paid by the Road Commission through this contract each year. The contract with the Road Commission is for 5 years and the previous amendment was passed as Reso2021-854. There are minimal changes between amendment IV and amendment V.
DISCUSSION:
the extension of this Contract will allow the County Agencies including the Road Commission to continue to combine efforts to stay in compliance with the State Permit. Due to changes to the permit requirements, the costs have increased from $125,000 to $130,000 per year. Of that $90,000 is general fund and the other $40,000 is paid by the Road Commission. This was included in the 2026-2027 budget funds.

LADIES AND GENTLEMEN:
BE IT RESOLVED, by this Board of County Commissioners of Genesee County, Michigan, that the request by the Drain Commissioner to authorize the Fourth Amendment to Agreement Re: Cost of Implementation of Phase II Storm Water Regulations between Genesee County and the Board of County Road Commissioners of the County of Genesee, for the purpose of meeting the Phase II Storm Water Regulations, is approved (a copy of the memorandum request and supporting documents being on file with the official records of the September 16, 2026 meeting of the Public Works Committee of this Board), and the Drain Commissioner is authorized to execute the contract amendment on behalf of Genesee County.
