BOARD ACTION REQUESTED:
GCMPC is requesting the Board of Commissioners to appoint committee members to the Genesee County Materials Management Planning Committee (MMPC) allowing staff to begin the plan development process. Staff is also requesting the ability to fill vacancies as needed with majority approval of the MMPC.
BACKGROUND:
Governor Whitmer signed an eight-bill package (HB 4454-4461, also known as Part 115 of the Natural Resources and Environmental Protections Act) into law on December 22, 2022. Effective March 29, 2023, this legislation updates Michigan’s solid waste management system with the primary intention of increasing the statewide recycling rate. As part of the new legislation, the Michigan Department of Environment, Great Lakes, and Energy (EGLE) is requiring each county in Michigan to develop a Materials Management Plan (MMP), previously called a Solid Waste Management Plan. The new MMPs will shift focus away from establishing landfill disposal capacity for garbage to waste diversion through recycling and composting programs. Funding will be provided by the State to counties to develop the new MMPs.
DISCUSSION:
GCMPC is requesting the Genesee County Board of Commissioners to appoint members to the newly established Genesee County Materials Management Planning Committee. The MMPC is a state-mandated committee which is made up of 11 members from various sectors including the materials management industry, environmental groups, and local government. The initial members of the committee will be appointed for a 5-year term. The planning committee’s primary role is to oversee the development and approval of the Materials Management Plan. The list of proposed members is attached. There currently are two positions on the MMPC where a specific person has not yet been identified. Due to this, and to allow flexibility in the future if positions become vacant, staff is requesting the ability to fill vacancies as needed with the approval from majority members of the MMPC. Once the MMPC members are appointed, staff can begin developing the work program for the MMP development process. After the MMPC and EGLE approve the work program, the drafting of the MMP begins. This is estimated to be a three-year process to complete the plan.

IMPACT ON BUDGET:
Development of the Genesee County Materials Management Plan will be funded through a Materials Management Planning Grant provided by the State to each County. Grant funding will be received once the County Approval Agency (CAA) appoints a Designated Planning Agency (DPA) as well as a MMPC and the DPA develops a work program that is approved by the MMPC and EGLE.

To meet Genesee County’s priority of inclusive, collaborate culture, the establishment of the Materials Management Planning Committee will bring a diverse group of representatives together to discuss the importance of waste diversion in the community. Each committee member’s personal and professional experiences will help guide the development of Genesee County’s Materials Management Plan which will set the foundation for future recycling and composting programs in the community.

TO THE HONORABLE CHAIRPERSON AND MEMBERS OF THE GENESEE COUNTY BOARD OF COMMISSIONERS, GENESEE COUNTY, MICHIGAN
LADIES AND GENTLEMEN:
WHEREAS, pursuant to MCL 324.11534, the Board of County Commissioners of Genesee County, Michigan (“this Board”), is authorized to appoint members to the Genesee County Materials Management Planning Committee (“MMPC”) to prepare and to oversee the development and approval of a materials management plan or amendment under the Natural Resources and Environmental Protection Act 451 of 1994 Part 115; and
WHEREAS, this Board has received written recommendations from the Genesee County Metropolitan Planning Commission (“GCMPC”) of eleven individuals recommended to serve on the MMPC; and
WHEREAS, a materials management planning committee appointed pursuant to MCL 324.11534 shall be appointed to a term of five (5) years.
NOW, THEREFORE, BE IT RESOLVED, that this Board hereby appoints, for a term of five (5) years, the individuals as recommended by the GCMPC, to serve on the MMPC, including:
