Resolution to authorize Drain Commissioner to sell real estate
BACKGROUND:
Public Act PA 342 requires County Board authorization to sell excess property
DISCUSSION:
Sanitary Sewer District No.3 owns parcel 01-04-200-003 in Argentine Township and abuts 7143 Rolston Road parcel 01-24-200-003. This parcel of land was acquired in 1978 for outfall discharge to the Shiawassee River from Rolston Road lagoons. In 1998 the treatment plant was expanded and a new outfall was established on our Hogan Road property. An outfall is currently not permitted for the parcel. In June of 2023, we were approached by Martin/Turner of 7143 Rolston Road if we would be willing to split a portion of our parcel and sell it to them. They request a 124’ by 541.35’ strip of land directly south of our parcel. The normal procedure would be to obtain an appraisal survey and then seek permission from the County Board for approval to sell the asset. Being approximately an acre, the appraisal would cost more than the value of the land therefore, we are requesting authorization to sell the strip of land for $5,000.00 without a detailed appraisal. The loss of this strip of land will not impact any future use of the remaining parcel. We are requesting the Public Works Committee to approve this request and move it forward to the full board for approval.

TO THE HONORABLE CHAIRPERSON AND MEMBERS OF THE GENESEE COUNTY BOARD OF COMMISSIONERS, GENESEE COUNTY, MICHIGAN
LADIES AND GENTLEMEN:
WHEREAS, this Board of County Commissioners of Genesee County, Michigan (“Board”), authorized the establishment of a system or systems of water, sewer, or sewage disposal improvements and services in accordance with Public Act 341 of 1939; and
WHEREAS, after authorizing the establishment of this public improvement, this Board designated the Genesee County Drain Commissioner (“Drain Commissioner”) to act as the County Agency for said public improvement; and
WHEREAS, the Drain Commissioner created the Division of Water and Waste (“Division”) to meet the needs of the County Agency; and
WHEREAS, the Division has determined that it has excess property, specifically parcel 01-04-200-003 in Argentine Township; and
WHEREAS, the Division desires to sell excess land on said parcel to an adjourning property owner; and
WHEREAS, the Division and/or the County Agency needs this Board’s permission before it can sell said excess land.
NOW, THEREFORE, BE IT RESOLVED, by this Board of County Commissioners of Genesee County, Michigan, that the request by the Deputy Drain Commissioner to grant the Drain Commissioner, as the County Agency, permission to sell a strip of excess land on parcel 01-04-200-003 in Argentine Township to the abutting property owner, at the price of $5,000.00 without a detailed appraisal, is approved (a copy of the memorandum request and supporting documents being on file with the official records of the September 11, 2024 meeting of the Public Works Committee of this Board).
