RE: Approval of a request to create, post & fill two (2) APA positions and to eliminate one (1) Deputy Chief Assistant Prosecutor position; THIS REQUEST IS A GENERAL FUND ASK FOR FY 2026-2027 OF $135,576.15
recommendation
BOARD ACTION REQUESTED:
The Prosecutor’s Office requests approval to establish, post, and fill for two (2) APA positions to replace the Special Assistant Attorney Generals positions (SAAGs).
BACKGROUND:
The Michigan Attorney General’s Office is ending the Special Assistant Attorneys General (SAAGs) program September 30th which will be a significant loss to our operations. We would like to transition both of these critical positions into the General Fund once the SAAG program ends.
DISCUSSION:
While we have had three SAAGs for several years, we currently only have two after one of the three retired. Both remaining SAAGs are very experienced prosecutors with a lot to offer the office; one position is assigned to our Appellate Division which has an ever-increasing caseload and the other is assigned to our Warrant Division which is a critical component to making sure new cases are promptly reviewed and acted upon to ensure cases move through the criminal justice system in an efficient manner.
IMPACT ON HUMAN RESOURCES:
Costs for posting, interviewing, and onboarding two (2) new employees
IMPACT ON BUDGET:
The cost would be up to $333,775.15 to the general fund for two (2) full-time positions One position is with family medical benefits package and the other has only individual medical benefits. In an effort to offset some of these costs in order to make this happen, we will not be filling the Deputy Chief Assistant Prosecutor position which was recently vacated by a retirement and which will be a savings to the General Fund of $198,199. SENIOR APA (SAAG) Previously Funded and Employed by AG’s Office 148,736.85 SENIOR APA (SAAG) Previously Funded and Employed by AG’s Office 185,038.30
IMPACT ON FACILITIES:
None
IMPACT ON TECHNOLOGY:
None
CONFORMITY TO COUNTY PRIORITIES:
Conforms to promote safe communities. These positions helps to ensure that public safety will not suffer by providing resources within the Prosecutor’s office for cases to proceed through the criminal justice system.
TO THE HONORABLE CHAIRPERSON AND MEMBERS OF THE GENESEE COUNTY BOARD OF COMMISSIONERS, GENESEE COUNTY, MICHIGAN
LADIES AND GENTLEMEN:
BE IT RESOLVED, by this Board of County Commissioners of Genesee County, Michigan, that the request by the Office of the Prosecuting Attorney to authorize establishing, posting, funding, and filling two (2) new Assistant Prosecuting Attorney positions to replace the State’s Special Assistant Attorneys General program and eliminating the Deputy Chief Assistant Prosecuting Attorney position to help fund the new positions, is approved (a copy of the memorandum request and supporting documentation being on file with the official records of the August 12, 2026 meeting of the Finance Committee of this Board).
