BOARD ACTION REQUESTED:
Authorization to proceed with a one-year extension on our current contract with the Michigan Department of Health and Human Services (MDHHS) to represent the Department in Family Court on Abuse and Neglect cases.
BACKGROUND:
For many years, the Prosecutor’s Office has contracted with MDHHS to represent the Department in Family Court on child abuse and neglect cases. Essentially a non-matching grant opportunity involving federal Title IV-E funds, the revenue from this contract helps fund the activities of four assistant prosecutors and one managing assistant prosecutor for the portion of their work associated with child abuse and neglect cases. Title IV-E funds are earned on a reimbursement basis; there are no prepayments for services. The amount of reimbursement is based on a formula that takes into account the amount of legal services and their associated costs provided by the Prosecutor’s Office to DHS.
DISCUSSION:
Title IV-E federal fund reimburses the State for costs associated with removing children from their homes due to abuse and neglect and placing them in in the care of foster parents. The Prosecutor’s Office represents MDHHS in Family Court to establish the Court orders that are necessary to remove abused and neglected children and place them in foster care.

None as it will maintain the current office structure.
IMPACT ON BUDGET:
The one-year contract will be for $300,000 and is a critical source of revenue to fund our abuse and neglect division.

CONFORMITY TO COUNTY PRIORITIES:
This grant advances the priority of safe communities by adding resources to address the serious issue of abused and neglected children in our County These grant funds also tie into the County’s value of service by giving us more resources to provide professional and competent service to abused and neglected children while at the same time helping secure the County’s financial stability by providing funds that otherwise would have had to come from the County’s general fund.

TO THE HONORABLE CHAIRPERSON AND MEMBERS OF THE GENESEE COUNTY BOARD OF COMMISSIONERS, GENESEE COUNTY, MICHIGAN
LADIES AND GENTLEMEN:
BE IT RESOLVED, by this Board of County Commissioners of Genesee County, Michigan, that the request by the Office of the Prosecuting Attorney to authorize entering into a one-year extension contract between Genesee County and the Michigan Department of Health and Human Services to provide for legal representation in abuse and neglect cases, in the amount of $300,000.00 for the period commencing October 1, 2026, through September 30, 2027, is approved (a copy of the memorandum request and supporting documentation being on file with the official records of the August 12, 2026 meeting of the Governmental Operations Committee of this Board), and the Chairperson of this Board is authorized to execute the contract extension on behalf of Genesee County.
